Return and Complaint Policy

The administrator of the simmering.pl website, TG Ersatzteile Polska Sp. z o.o., ensures high-quality service and products. In cases where the purchased goods do not meet expectations or have defects, the customer has the right to return the product or file a complaint in accordance with applicable Polish law.

1. Right of Withdrawal (Product Return)

In accordance with the Consumer Rights Act of May 30, 2014, a consumer has the right to withdraw from a distance contract without providing any reason within 14 days of taking possession of the goods.

  • To exercise the right of withdrawal, the consumer must inform TG Ersatzteile Polska Sp. z o.o. of their decision by submitting an unequivocal statement (e.g., by post, fax, or email).
  • The consumer may use the withdrawal form available on the simmering.pl website, but it is not mandatory.
  • If the consumer withdraws from the contract, the returned goods should be in their original, unused condition, unless usage was necessary to ascertain the nature, characteristics, and functionality of the product.
  • The return must be made to the address provided by TG Ersatzteile Polska Sp. z o.o. within 14 days from the date the withdrawal notice was submitted.
  • The costs of returning the goods are borne by the consumer unless the seller agrees to cover these costs.

2. Product Complaints (Warranty)

If the purchased goods are found to be defective, the customer has the right to file a complaint under the provisions of the Polish Civil Code regarding warranty for physical or legal defects (Articles 556–576 of the Civil Code).

  • A complaint can be submitted by contacting TG Ersatzteile Polska Sp. z o.o. via email, contact form, or in writing to the company’s address.
  • In the complaint, please provide contact details, order number, a description of the defect, and the desired resolution (e.g., repair, replacement, price reduction, or withdrawal from the contract and refund).
  • TG Ersatzteile Polska Sp. z o.o. commits to resolving the complaint within 14 days from the date of receipt. The customer will be informed of the decision either electronically or in writing.
  • If the complaint is accepted, the costs related to returning the defective goods and shipping the repaired or replaced product will be covered by the seller.

These rules are effective from October 8, 2024 and are in accordance with the applicable laws in Poland.

4. Final Provisions

These rules do not limit or exclude any consumer rights arising from the applicable laws in Poland, including the Consumer Rights Act and the Civil Code.


Return and Complaint Policy for B2B Customers

The administrator of the simmering.pl website, TG Ersatzteile Polska Sp. z o.o., informs that the return and complaint policy for B2B customers complies with applicable Polish law and individual commercial agreements.

1. Product Returns (Withdrawal from the Contract)

In the case of purchases made by businesses, product returns may be handled based on separate agreements between the parties. Due to the nature of B2B transactions, the right of withdrawal without providing a reason, as provided by the Consumer Rights Act, does not apply.

  • A product return is only possible with the consent of TG Ersatzteile Polska Sp. z o.o. and must comply with the terms agreed upon in the contract or offer.
  • In the event of an agreed return, the product must be returned in its original, unused, and complete condition, and the return shipping costs are covered by the buyer.
  • Only unused products are eligible for return, in accordance with the terms specified in the contract.

2. Product Complaints

B2B customers have the right to file complaints for physical or legal defects in the products in accordance with the Polish Civil Code regulations regarding warranty for defects.

  • Complaints can be submitted via email or in writing to the address of TG Ersatzteile Polska Sp. z o.o.. The complaint should include the company details, order number, defect description, and the preferred method of resolution (e.g., repair, replacement, price reduction).
  • TG Ersatzteile Polska Sp. z o.o. commits to resolving the complaint within 14 days from the date of receipt. The decision will be communicated to the customer in writing or electronically.
  • If the complaint is accepted, the seller will cover the costs associated with returning the defective goods and shipping the repaired or replaced product.

3. Additional Provisions

  • All returns and complaints will be handled in accordance with the commercial agreements between TG Ersatzteile Polska Sp. z o.o. and the contractor.
  • In the case of specialized products that were manufactured or ordered individually, returns or exchanges may not be possible unless otherwise agreed in the contract.
